It doesn't matter what scenario you make up, because you're still downloading software for free. Revenue is lost because people won't buy the software if they know it is out there for free somewhere.
Just like with music. Artists put their cds out there to sell, but if one person buys the cd, uploads it, and everyone in the world downloads the cd rather than buying it, then that artist has had one record sell. There is already a company that uses Exabyte as a trademark, and since they are already into hardware they would fight your trademark and probably win. They can say that since names are so similar that people will think it was them, not you, who is putting out the software.

Exabyte was bought out by tandberg data and currently hold the trademark for exabyte, and they can still claim damages from you. There are may trademarks out there that are basically dead, but owned by others just because they aren't currently using them doesn't mean they can't sue you [...]
